Criminal charges have been dropped against a former Whitewater High School coach and teacher.
According to Fayette County District Attorney Scott Ballard, a felony charge of sexual exploitation of a minor against Harry Heintz has been dismissed.
Heintz was charged last November after deputies said he sent an inappropriate text message to a student asking her to send him a picture of herself.
“When we began reviewing the test messages, we felt some of the statements he made may have been inappropriate to a student, but they were not illegal,” said Ballard.
“We felt he did not commit a crime.”
A copy of the text transcripts, obtained through an open records request from the Fayette County Sheriff’s Department, includes a number of texts between Heintz and a student on Oct. 26.
In the texts, records show Heintz asks the girl to send him a picture.
“Don’t send a crap shot. Send me a good one,” the transcripts state.
“As in what’s a crap shot?” she asked.
“I don’t know, like blurry... or a myspace pic,” he replied.
“No peace sign... you can be butt XXX naked butt no peace sign.”
The text transcripts show a conversation continuing between the two.
“I do believe these conversations may have been inappropriate for a a student and teacher, but no laws were broken as far as we can tell.”
At the time of his arrest, officials said it appeared that the photograph was never sent.
According to officials, Heintz -- who was an assistant football coach, weightlifting coach and World History teacher -- resigned just prior to his arrest.
